INCIDENT COVER NOTE — ATTEMPTED UNAUTHORIZED ENTRY / REQUEST TO DOCUMENT CRIMINAL TRESPASS
Summary of Incident:
On September 22, 2025, at approximately 11:30 a.m., Rose Hall Apartments’ staff knocked at my unit and then attempted to use a property passkey to open the door, despite my September 21, 2025 written notice advising management that (1) access could not occur on September 22, 2025, and (2) that any access thereafter must be requested only after October 1, 2025, with a written agenda submitted in compliance with Virginia law.
The attempted entry occurred the very next morning, before management submitted any lawful request or agenda. I was inside, secured the interior lock, and prevented entry. This constitutes an attempted unlawful entry and may rise to the level of criminal trespass.

TIMELINE OF EVENTS
Sept. 21, 2025, 8:11 p.m. — Tenant emailed management: stated access could not occur on Sept. 22, and required that any future entry be proposed after Oct. 1, with a written agenda, subject to compliance with law.


Sept. 22, 2025, approx. 11:30 a.m. — Staff knocked and attempted entry with a passkey without waiting for Oct. 1 or providing the required agenda.


Tenant action — Prevented entry by securing lock, documented with photos, and preserved email evidence.



LEGAL BASIS
Va. Code § 55.1-1229 — Landlord access must be reasonable, coordinated, and not abusive or harassing.


Va. Code § 18.2-119 — Entering or attempting to enter against written notice and without consent may constitute trespass.



NOTICE OF TRESPASS WARNING — DO NOT ENTER WITHOUT CONSENT

To Rose Hall Management:
This is formal written notice that no entry to my dwelling unit is authorized except in true emergencies as defined by Virginia law (Va. Code § 55.1-1229).
On September 21, 2025, I provided written direction that:
No access would be permitted on September 22, 2025.


Any access after October 1, 2025 must first be proposed in writing with a detailed agenda of intended work or inspection.


Access will only be considered if such request complies with the Virginia Residential Landlord and Tenant Act and is accepted in writing by the tenant.


Despite this, on September 22, 2025 at approximately 11:30 a.m., your staff attempted to use a passkey to open my door without consent, without waiting until after October 1, and without providing the required agenda.
Be advised:
Any further attempt to enter my unit without a lawful request, agenda, and my written consent will be treated as criminal trespass under Va. Code § 18.2-119.


I will immediately call the Virginia Beach Police Department, provide officers with my prepared evidence packet, and request criminal charges.


This notice and supporting documentation will also be used in civil proceedings against Rose Hall and its agents.


You are hereby on notice: Access is not automatic on or after October 1. Entry remains conditional, requiring prior written coordination, a lawful agenda, and my explicit consent.

This is formal notice that you have pending court service which has not been responded to. You are currently under legal deadlines based on the date these documents were sent to your office address, email, and fax number.
Be advised that a police protection order has already been issued regarding unauthorized access to my apartment. Despite this, personnel, including pest control, have entered my unit without my consent. Any further unauthorized entry will be reported immediately to law enforcement.
You are hereby directed to:
Acknowledge receipt of all court documents previously sent to your office, email, and fax.


Respond immediately in writing regarding any outstanding legal obligations.


Cease all attempts to enter my apartment without explicit, lawful permission.


Failure to comply with this notice and to respect your legal deadlines will result in immediate legal action, including direct notification to law enforcement and the court. You are on notice that continued disregard of your legal obligations will be considered a willful violation of both tenant protections and court service requirements.
This letter will be retained as part of the record and may be submitted to the court as evidence of your knowledge of pending obligations and disregard for legal notice.
